Administrative Directive

Introduction

The purpose of this policy is to specify the policy and procedures governing holiday time off and compensation.

1. General

1.1 It is the policy of Central New Mexico Community College (CNM) that paid holidays will be designated each year for regular full-time non-instructional employees.  In accordance with the CNM Governing Board Policy Handbook Section 5.09, the CNM Governing Board annually adopts the official College calendar, which identifies the College observed holidays.

1.2 A Collective Bargaining Agreement may override this policy. Contact Human Resources to identify employee classifications covered by an approved Collective Bargaining Agreement.

2. Holidays Observed

2.1 The College typically observes the following holidays:

2.1.1  Martin Luther King Day - 3rd Monday in January

2.1.2  Memorial Day - last Monday in May

2.1.3  Independence Day - July 4

2.1.4  Labor Day - 1st Monday in September

2.1.5  Thanksgiving Day - 4th Thursday in November

2.1.6  Day after Thanksgiving 4th Friday in November

2.1.7  Winter Break   specific days are determined each year by the Governing Board.

2.2   The holiday is observed on the calendar day designated with the exception of the following for those employees working a Monday through Friday schedule:

2.2.1 When a holiday falls on a Saturday, it will normally be observed on the preceding Friday.

2.2.2 When a holiday falls on a Sunday, it will normally be observed on the following Monday.

3. Eligible Employees

3.1 All regular full-time non-instructional employees are eligible to receive pay for holidays.  The applicable contract language regarding holiday pay covers employees covered by a Collective Bargaining Agreement.

3.1.1 To be eligible for holiday pay, an employee must be in full work status or on approved paid leave status the last regularly scheduled work day preceding the holiday and the first regularly scheduled work day immediately following the holiday. (This requirement does not apply to employees who will retire during the holiday period.  For example, a retiring employee whose separation date from CNM is December 31st will be entitled to winter break holiday pay through December 31st, even though the individual did not work the last regularly scheduled work day before the holiday or the first regularly scheduled work day after the holiday).

3.1.2  Employees who would otherwise be eligible, but who are on a leave of absence without pay not involving FMLA, workers compensation leave, or disciplinary suspension will not be entitled to pay for the recognized holiday.

3.1.3 Eligible employees who are on vacation during a recognized holiday will have the day treated as a paid holiday, and may substitute the holiday for a day of annual leave, unless the holiday occurred on a normally unscheduled workday.

3.2 Instructional employees receive their normal pay when the College closes on an instructional day to observe a holiday.

4. Ineligible Employees

4.1  Non-exempt part-time non-instructional employees, temporary and casual employees do not receive pay for holidays.

4.1.1  Employees not eligible for holiday pay who are required to work on a holiday, will be paid at double time and one-half for the hours worked on the holiday.

5. Shift Assignment

6. Holiday Observed on Normal Day Off

6.1 When a holiday falls on an employees regular day off, the holiday is normally granted on the work day immediately preceding or immediately following the employees regular day off.

6.1.1 If an alternative day off cannot be granted within the workweek, the employee shall be paid for the holiday and shall be granted time and one-half for any hours worked over 40 in the workweek to include the holiday hours.

6.2 The applicable contract language regarding holidays applies to employees covered by a Collective Bargaining Agreement.

7. Holiday Compensation

7.1 Employees eligible to receive holiday pay are paid for eight (8) hours for the holiday. Those employees working a longer shift must take annual leave, personal leave or leave without pay for time beyond 8 hours.

7.2 Eligible employees receive their straight time rate of pay for the holiday except as follows:

7.2.1 Full time non-exempt employees required to work on the holiday shall receive one and one half times their straight time rate of pay for all hours worked on the holiday plus holiday pay at their straight time rate of pay for eight hours.

7.3 Instructional employees do not receive holiday pay.  They will receive their normal pay should the College close on an instructional day in observance of a holiday.

7.4 Full time exempt employees required to work on the holiday shall not receive any additional compensation for the holiday.
